Attorney General finds City of Parshall mishandled public records exemption

On December 5, 2025, the North Dakota Attorney General’s Office issued an opinion regarding a records request involving the City of Parshall. The opinion addressed how the city handled fees and access to public records.

According to Opinion 2025-O-17, the City of Parshall charged what was determined to be a reasonable fee for providing requested records. The opinion also found that the city properly provided some of the requested records.

However, it concluded that the City of Parshall improperly denied part of a records request by citing exempt or confidential information rather than redacting those portions and releasing the rest. The guidance from the Attorney General indicates that in such cases, government entities should redact only the exempt or confidential parts and provide access to non-exempt information.
