Attorney general finds Williston Council for the Aging complied with open records law

On December 5, 2025, the North Dakota Attorney General’s office issued an opinion regarding the Williston Council for the Aging, Inc. The opinion determined that the organization did not violate state open meetings or open records laws.

According to the opinion, as a private nonprofit that receives public funding, the Williston Council for the Aging is only subject to North Dakota’s open government laws in relation to those funds. The organization was found to have provided all necessary records and notice as required by law.

The official statement reads: “The Williston Council for the Aging, Inc. did not violate North Dakota’s open meetings or open records law. As a private nonprofit supported by public funds, it is subject to the laws only to the extent of those funds, and it provided all required records and notice in accordance with North Dakota law.”

This conclusion clarifies how such nonprofits must comply with transparency requirements when they receive public funding.
