On January 30, 2026, the North Dakota Attorney General’s office issued an opinion regarding a records request made to the Department of Health and Human Services (DHHS). Sheri McMahon had asked whether DHHS failed to provide certain records sent from DHHS to the Centers for Medicare & Medicaid Services (CMS), potentially violating state law N.D.C.C. § 44-04-18.

The Attorney General’s office found that DHHS “substantially complied with N.D.C.C. § 44-04-18 when it denied Ms. McMahon’s request for the records that DHHS transmitted to CMS relating to the EMT ALA complaint, as North Dakota’s agreement with the United States Department of Health and Human Services prohibits disclosure of the requested records.”
