North Dakota Supreme Court issues notices of comment on proposed rule amendments

The North Dakota Supreme Court announced on Apr. 14 that it has issued Notices of Comment for several proposed amendments to court rules and procedures.

These notices are important because they allow members of the public and legal community to provide feedback before any changes are finalized, helping ensure transparency and participation in the rulemaking process.

According to the announcement, comments are being sought on amendments related to multiple areas. The matters include changes to North Dakota Rules for Lawyer Discipline sections 6.4 and 6.5, Rules of the Judicial Conduct Commission section 7, North Dakota Rules of Court section 8.9, Admission to Practice Rule 16, and North Dakota Supreme Court Administrative Rule 49 concerning immunity provisions (case number 20250243). Another set of proposed amendments concerns North Dakota Rule of Juvenile Procedure section 17 regarding juvenile court lay guardians ad litem (case number 20250334). Additionally, amendments have been suggested for several parts of the North Dakota Rules of Appellate Procedure: section 3 (appeal as of right – how taken), section 12 (docketing the appeal), section 29 (briefs by amicus curiae), section 35 (scope of review), and section 40 (petition for rehearing) under case number 20260119.

The notice states that these opportunities for comment are provided under N.D.R.Proc.R. § 7.

The process allows interested parties a chance to review proposals and share their perspectives with the Supreme Court before decisions are made.
